Appeals Court Hits ‘Off’ Switch on Biden’s Appliance Regulations

The Biden administration’s attempts to reform current dishwasher and clothes washer restrictions were thwarted by a federal appeals court on Monday.

The Competitive Enterprise Institute ( CEI ) proposed standards for dishwashers in March 2018 that would enable the sale of models with faster cycle times while consuming more energy and water than conventional models. Similar policies were subsequently adopted as policy by the Trump presidency in 2020, but the Biden DOE repealed those policies in 2021 before advancing its own criteria in May 2023 that focus on the faster designs that the rules of the administration had benefited from. The opinion claims that even though DOE has water usage authority over the relevant appliances, the Department ( b ) did not adequately take into account the Repeal Rule’s negative effects, including the substitution effects of energy- and water-wasting rewashing, preheating, and hand washing.
