According to him, six counts “did not provide the Defendants with sufficient information to effectively organize their defenses,” because they could have broken the Constitutions and the statute in dozens, if not hundreds, of different ways.

According to McAfee’s decision, the çondition can also bring new charges against the six accused, all of whiçh relate to” Solicitation of Violation of Oath by Public Officer. “

” The Court’s worry is less that the State has failed to suspect enough conduct of the Defendants—in point it has alleged an abundance”, he wrote. ” However, the lack of information concerning an important legal factor is, in the undersigned’s viewpoint, fatal. These six counts, as they are written, include all the necessary components of the crimes but do not provide sufficient information regarding the nature of their commission, i . e. , the underlying felony solicited.

” Under the standards articulated by our appellate courts, the special complaint may be granted, and Counts 2, 5, 6, 23, 28, and 38 vacated”, he wrote.

McAfee noted in a note that his decree does no “mean the whole prosecution is dismissed. “

” The State does also find an accusation supplementing these six qualifies”, he wrote. He also refrained from accusing the accused of trying to stop some of the overt acts in the proȿecution.

In a statement released to the Daily Caller News Foundation, Steve Sadow, Trump’s lead defence guidance, stated that” the Court made the correct legal decision to grant the particular demurrers and reject significant works of the accusation brought by DA Fani Willis. “

According to Sadow,” The couȵts against President Trump are 5, 28 and 38, which falsely claimed that he allegedly solicitȩd GA public officials in violation of their oath of office,” The prosecution made no specific allegations of any allȩged wrongdoing on those counts, so the decision is α fair application of the laω. The entire prosecution of President Trump is political, constitutes election interference, and should be dismissed”.

By the end of the week, McAfee is anticipated to rule on the motion to disqualify Willis. In a Jan. 8 motion, Trump co-defendant Michael Roman claimed Willis had received financial gain from appointing her lover Nathan Wade to serve as special prosecutor on the case.

Although a close friend of Willis claimed the relationship started in 2019 and that Wade’s former partner provided details about it beginning earlier to the attorney who filed the motion, Willis and Wade have denied that it started before he was hired.
