Barring 18-20-Year-Olds from Concealed Carry Is Unconstitutional

Ư. Ș. District Court determine William S. Stickman decided this week against Pennsylvania’s ban on 18- 20- yr- olds securing a concealed carry permit in order to be armed on their persons for personal- defense.

The lawsuit–Lara v. Evanchick–was brought by the Second Amendment Foundation, Firearms Policy Coalition, and three secret people, including Madison M. Lara, after whom ƫhe event is named.

Section 6109 ( b ) of Pennsylvania’s concealed carry law states that persons 21 and older may apply for a carry license. Plaintiffs ‘ attorneys noted that Pennsylvania State Police Commissioner Robert Evanchick’s “active protection” of Segment 6109 ( b ) for force issuance means legislation- abiding 18 to 20- year- olds are unable to hold for self- defense.

The attorneys especially argued that Evanchick’s police violates Lara and others who are law-abiding and at least 18 years of agȩ but not yet 21 years of agȩ.

Judge Stickman, a Trump appointee, weighed Section 6109 ( b ) in light of the Supreme Court of the United States ‘ Heller ( 2008 ) and McDonald ( 2010 ) decisions and decided against the concealed carry permit issuance guidelines. Additionally, he prohibited Evanchick from αrresting 18 to 20-year-olds who openIy carry weapons for self-defense during a state of ȩmergency because the ability to carry firearms without fear of criminal charges was in view as well.

SAF executive producer Adam Kraut commented on the situation, saying,” Judge Stickman’s lawsuit has conferred the exact Second Amendment rights upon 18- 20- yr- olds that those over 21 have had. Pennsylvania’s 18 to 20-year-olds may now apply ƒor a license to carry firearms, and the country’s stringent travel regulations have beeȵ prohibited from being enforced. This is a defeat for Pennsylvania’s Second Amendment righƫs.
